IMPORTANT NOTICE. Procks is a location-based application. By using the Service, you share your precise geographic location with Procks LLC and, depending on your settings, with other users. Please read this Privacy Policy carefully to understand how we collect, use, disclose, and protect your information.
Procks LLC (“Procks,” “we,” “us,” or “our”) provides the Procks mobile application and related services (collectively, the “Service”), a location-based platform that allows users to share their geographic location, view other users in proximity, share content, and exchange messages with users nearby.
This Privacy Policy describes how we collect, use, disclose, and safeguard information about users of the Service (“you” or “User”). It applies to all individuals who access or use the Service. By using the Service, you acknowledge that you have read and understand this Privacy Policy. Your use of the Service is also governed by our Terms and Conditions, which are incorporated by reference.
If you do not agree with this Privacy Policy, you must not access or use the Service.
This Privacy Policy applies to information we collect through the Service, including the Procks mobile application, our websites, customer-support communications, and any other Procks-branded interfaces that link to this Privacy Policy. It does not apply to (a) information collected by third parties, including third-party websites, services, or applications you access through the Service; (b) information collected by other users of the Service; or (c) information you choose to make publicly available through the Service.
We collect information in three principal ways: information you provide directly, information collected automatically, and information from third parties.
PRECISE LOCATION DATA IS THE CORE OF THE SERVICE AND IS INHERENTLY SENSITIVE. By using the Service, you expressly consent to our collection, use, processing, transmission, storage, and disclosure of your precise location data as described in this Privacy Policy.
You acknowledge and accept the following risks associated with sharing precise location:
You may disable location access at any time through your device settings or within the Service. Disabling location access will substantially limit or disable Service functionality. You can also delete your account at any time as described in Section 9.
We use information we collect for the following purposes:
We may share your information in the following circumstances:
The core function of the Service is to share information with other users in your geographic proximity. By design, the following information is or may be visible to other users: your username, profile information, photos, location (in approximate or precise form, as applicable), User Content, messages you send to proximate users, and any other information you choose to share. You acknowledge that anything visible to other users may be copied, screenshotted, or further shared by them, and we have no control over such use.
We share information with third-party service providers who perform services on our behalf, such as cloud hosting, data storage, analytics, customer support, payment processing, fraud prevention, communications, mapping, and advertising. These providers are contractually obligated to use information only as necessary to perform services for us.
We may share information with advertising networks, analytics providers, and measurement partners to deliver and measure advertising, including ads that may be tailored based on your interests, location, or activity. These partners may use cookies, SDKs, and similar technologies to collect information about your activities over time and across services.
If Procks is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and any choices you may have.
We may disclose information when we believe in good faith that disclosure is necessary or appropriate to: (a) comply with applicable law, regulation, legal process, or governmental request; (b) enforce our Terms or other agreements; (c) detect, investigate, prevent, or address fraud, security, or technical issues; (d) protect the rights, property, or safety of Procks, our users, or others; or (e) respond to claims that any User Content violates the rights of third parties.
We may share information with third parties when you direct us to or otherwise consent.
We may share aggregated, anonymized, or de-identified information that does not reasonably identify you for any purpose.
We retain your information for as long as your account is active or as needed to provide the Service, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate business purposes.
Specific retention periods vary based on the type of information, the purpose for which it is processed, and applicable legal requirements. Location data is generally retained for the period necessary to provide the Service and for analytics, safety, and legal purposes. We may retain certain de-identified or aggregated information indefinitely.
When information is no longer needed, we will delete or anonymize it, unless we are required by law to retain it longer.
We implement administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, and destruction. These safeguards may include encryption in transit and at rest, access controls, monitoring, and personnel training.
HOWEVER, NO METHOD OF TRANSMISSION OR STORAGE IS 100% SECURE. We cannot and do not guarantee the absolute security of your information. You provide information at your own risk. If you have reason to believe that your account or information is no longer secure, please contact us immediately.
You may review, update, or correct your account information at any time through your account settings. You may delete your account by following the deletion instructions within the Service or by contacting us. After deletion, we may retain certain information as required by law or for legitimate business purposes.
You can enable, restrict, or disable location access at any time through your device settings. Disabling location access will significantly limit or disable Service functionality.
You may opt out of promotional emails by following the unsubscribe link in those messages. You cannot opt out of service-related communications (such as security alerts and account notices) while you maintain an account.
You can manage push notifications through your device settings or in-app settings.
You can manage cookies through your browser settings and limit ad tracking through your device’s privacy settings (e.g., Limit Ad Tracking on iOS, Opt Out of Ads Personalization on Android).
Some browsers transmit “Do Not Track” signals. Because there is no industry-standard interpretation of these signals, the Service does not currently respond to them.

Procks does not sell personal information for monetary consideration. However, our use of advertising and analytics technologies may constitute “sharing” or “sale” under California law. If you are located in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland, the General Data Protection Regulation (“GDPR”) and equivalent laws apply to our processing of your personal data. Procks LLC is the controller. You have rights including access, rectification, erasure, restriction, objection, data portability, and the right to withdraw consent. Residents of other jurisdictions (including, without limitation, Brazil under LGPD, Canada under PIPEDA, and Australia under the Privacy Act) may have additional rights under local law. Contact us to exercise such rights.
We and our third-party partners use cookies and similar technologies to operate the Service and analyze its use. Categories include: Strictly Necessary, Functional, Performance/Analytics, and Advertising. You can manage your preferences via your device or browser settings.
The Service is not directed to, and is not intended for use by, children under the age of 18 (or the age of majority in your jurisdiction, if higher). We do not knowingly collect personal information from children under 13 in violation of the Children’s Online Privacy Protection Act (“COPPA”), nor do we knowingly process the data of minors in violation of GDPR or other applicable laws. If we become aware that we have collected personal information from a person under the required age without verifiable parental consent, we will take prompt steps to delete that information and terminate the account. Contact admin@procks.com if you believe a child has provided personal information.
The Service may contain links to or integrate with third-party services, websites, or applications that we do not own or control. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with information.
Procks is based in the United States, and the Service is operated from the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries that may have data-protection laws different from those in your jurisdiction. By using the Service, you consent to such transfer, storage, and processing, subject to safeguards described in Section 10.3 where applicable.
We may update this Privacy Policy from time to time. The most current version will be posted within the Service or on our website with the “Last Updated” date revised. If we make material changes, we will provide notice (e.g., by in-app notification, email, or other reasonable means). Your continued use of the Service after the effective date of the revised Privacy Policy constitutes your acceptance of the changes.
